TERMS AND CONDITIONS

These Terms and Conditions ("Terms") govern your access to and purchase of digital products, strategy sessions, consulting services, creative services, and related offers from Moonieful Designs LLC ("Moonieful," "we," "us," or "our").
By purchasing, booking, accessing, or using any of our products or services, you agree to these Terms.

2. WHAT WE OFFER
Moonieful offers digital products, templates, guides, trainings, strategy sessions, brand reviews, consulting services, and custom creative services.
The exact scope, deliverables, timing, and exclusions for each offer are described on the applicable sales page, checkout page, confirmation email, onboarding materials, or signed client agreement.
If a specific offer page, order form, or signed agreement includes additional terms, those terms control for that specific purchase to the extent of any conflict with these Terms.
3. ELIGIBILITY AND ACCURACY OF INFORMATION
You agree to provide accurate, current, and complete information when making a purchase, booking a service, or submitting an intake form.
We may refuse, cancel, or limit any order if we believe the information provided is inaccurate, incomplete, fraudulent, abusive, or creates legal, operational, or payment risk.
4. PAYMENTS
All prices are listed in USD unless otherwise stated.
By submitting payment information, you authorize us and our payment processors to charge the total amount shown at checkout, including any applicable taxes, fees, order bumps, or upsells you affirmatively select.
You are responsible for reviewing the product name, billing type, and total price before completing your order.
We may use third-party payment processors to process transactions securely.
5. DIGITAL PRODUCTS
When you purchase a digital product, you are buying a personal, non-exclusive, non-transferable license to access and use the material for your own business or personal use, unless the offer expressly states otherwise.
You may not:
resell, redistribute, sublicense, or share the product
copy or publish the product as your own
upload the product to shared libraries, marketplaces, or group folders for public or team-wide redistribution unless your license expressly allows it
remove copyright, trademark, or proprietary notices
All intellectual property in our materials remains owned by Moonieful Designs LLC or its licensors.
6. STRATEGY SESSIONS, BRAND REVIEWS, AND SERVICE-BASED OFFERS
Some Moonieful offers include strategy sessions, reviews, consulting, or custom services.
Unless an offer clearly says otherwise, strategy and review offers are advisory and diagnostic in nature. They do not include full implementation, done-for-you page builds, unlimited revisions, or ongoing support.
For service-based and strategy-based offers, you agree to:
complete required intake forms or onboarding steps on time
attend scheduled calls at the agreed time
provide timely information needed for us to perform the service
review deliverables promptly
If your offer includes a call, you are responsible for showing up on time using the booking or meeting link provided.
7. SCHEDULING, RESCHEDULING, AND NO-SHOWS
For booked sessions:
you may reschedule once with at least 24 hours’ notice
cancellations or reschedule requests made with less than 24 hours’ notice may be treated as a no-show
no-shows may be forfeited and may not be refunded
if Moonieful needs to reschedule, we will offer a new time or, if appropriate, a refund
For larger custom projects, scheduling, milestones, and revision terms may be governed by a separate signed agreement.
8. REFUNDS AND CANCELLATIONS
Your purchase may be covered by a separate Refund Policy or an offer-specific refund statement on the applicable sales page or checkout page.
Unless a specific offer explicitly states otherwise:
digital products are final sale once access or delivery is provided
booked service time, completed work, and work already started are non-refundable
custom services, retainers, and milestone-based work are governed by the payment and cancellation terms in the applicable signed agreement
If a specific sales page or checkout page includes a stated guarantee or refund window, that offer-specific policy controls for that purchase.

9. DELIVERY AND ACCESS
For digital products, access is typically delivered by email, download link, portal access, or another method described at checkout.
For strategy and service offers, next steps may include booking links, intake forms, onboarding emails, call invitations, and deliverable timelines.
You are responsible for checking your inbox, spam folder, and promotions tab, and for contacting us if you do not receive your access or next steps within the stated timeframe.
10. CLIENT RESPONSIBILITY AND NO RESULTS GUARANTEE
We make every effort to describe our offers clearly and deliver them as described.
However, we do not guarantee specific business, financial, marketing, traffic, sales, lead, or revenue outcomes.
Your results depend on many factors outside our control, including your offer, market, implementation, experience, consistency, timing, and business decisions.
Nothing in our products, services, content, or communications is a promise or guarantee of earnings or business growth.
11. EDUCATIONAL AND INFORMATIONAL USE ONLY
Our materials are for educational and informational purposes only.
We do not provide legal, tax, accounting, medical, mental health, or other regulated professional advice unless explicitly stated and legally qualified to do so.
You should consult your own qualified advisor where appropriate.
12. ACCEPTABLE USE
You agree not to misuse our site, products, portals, templates, or services.
You may not:
use our materials for unlawful purposes
infringe our intellectual property rights
attempt to reverse engineer, scrape, hack, disrupt, or interfere with our systems
impersonate another person or submit false information
use our content in ways that are abusive, defamatory, fraudulent, or misleading
We may suspend or terminate access if these Terms are violated.
13. TESTIMONIALS, REVIEWS, AND FEEDBACK
Nothing in these Terms limits your right to leave an honest review of your experience.
If you voluntarily send us feedback, suggestions, or comments about our products or services, we may use that feedback internally to improve our offerings.
If we want to publicly use your testimonial, name, business name, likeness, or quoted feedback in marketing, we may ask for permission separately.
14. THIRD-PARTY TOOLS AND LINKS
Our products or services may reference or integrate third-party tools, platforms, processors, schedulers, AI tools, or websites.
We are not responsible for the policies, availability, content, or actions of third parties. Your use of third-party services is subject to their own terms and policies.
15. CHARGEBACKS AND PAYMENT ISSUES
If you believe you were charged in error or need help with your order, contact us first at miki.@moonieful.com so we can try to resolve it promptly.
We reserve the right to provide relevant order records, delivery records, onboarding records, communications, and other fulfillment evidence to payment processors in response to disputes or chargebacks.
16. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Moonieful Designs LLC will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising from or related to your use of our products, services, website, or materials.
To the maximum extent permitted by law, our total liability for any claim related to a purchase or service will not exceed the amount you paid us for the specific product or service giving rise to the claim.
17. INDEMNIFICATION
You agree to indemnify and hold harmless Moonieful Designs LLC and its owners, officers, contractors, affiliates, and representatives from claims, damages, losses, liabilities, costs, and expenses arising out of your misuse of our products, breach of these Terms, or violation of law or third-party rights.
18. GOVERNING LAW
These Terms are governed by the laws of the State of Texas without regard to conflict of law principles.
Any dispute arising out of these Terms shall be brought in the state or federal courts located in Bexar County, TX, unless applicable law requires otherwise.
19. SEVERABILITY
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
20. NO WAIVER
If we do not enforce a provision of these Terms, that does not mean we waive our right to enforce it later.
21. CHANGES TO THESE TERMS
We may update these Terms from time to time. The version posted on this page will control going forward as of its effective date.
